On the land-based front, we do not expect too much growth. With the Introduction of the William Hill Sports Book in Tropicana Casino, there is only two candidates left in Atlantic City to launch books. One, Hard Rock Casino, we hope to go live with a retail publication this year, as Hard Rock has already signed a Letter of Intent with Gaming Innovation Group to an omni-channel sportsbook platform.
As mentioned, Freehold Raceway, owned by Penn National Gaming and Greenwood Gambling (owner of Parx Casino in Pennsylvania) is also a prime candidate to enter the land-based sports betting kingdom.
On the internet front, there’s a lot more space to maneuver as each sports betting license holder is entitled to three branded websites, or skins. Some, like Monmouth Park and Resorts AC, have already debuted two skins, but many others, such as heavyweights Tropicana, Hard Rock Casino, and Golden Nugget, haven’t launched any. Expect multiple AC-branded online sportsbooks to pop up at the not-so-distant near future, and also for different companies like the Kindred Group (now adapting with Hard Rock Casino) and Australian-based PointsBet (partnered with the Meadowlands) to also launch online books in New Jersey.
After the smoke clears it will not be unheard of to find upwards of 30 online sportsbooks in New Jersey.
Regulations, taxes, and earnings It was only a few brief weeks after the U.S. Supreme Court kicked PASPA to the wayside that New Jersey passed sports betting legislation. The bill passed by unanimous vote in both chambers and has been swiftly signed into law by Governor Phil Murphy (who happened to place the first bet at Monmouth Park after that week) on June 11.
Regulation of this industry was passed off to the NJ Division of Gaming Enforcement, the exact same agency that manages oversight for Atlantic City casinos and online gaming sites in New Jersey. Fortunately, the state had been primed to supply sports betting for several years, enabling regulators to release emergency regulations only two weeks following Murphy penned the sports betting bill into legislation.
New Jersey law mandates that only qualified casinos and racetracks be eligible for a sports gambling license, and that online sportsbook operators must be partnered with a license holder. Other points of interest:
The fee for a sports wagering permit was set at a minimum of $100,000
The tax rate is set at 8.5% for land-based venues, and 13% for online websites, with horsemen required to pay an additional 1.25percent to the Department of Local Government Services at the Dept. of Community Affairs.
License holders are limited to three individually branded sites, or skins.
Wagering on college sports is allowed, unless a New Jersey college or college team is involved. Then it’s a no-go.
Permit holders have a 270-day window (transactional waiver) to run online sportsbooks at the absence of a bodily sportsbook.
New Jersey does not pay an integrity fee to professional sports leagues in market for data and league oversight, nor will it probably ever.
With regards to manage, New Jersey books took $184 million in bets during September 2018. And out of June — September, the industry generated over $40.4 million in earnings. A brief history of New Jersey sports betting New Jersey’s battle to legalize sports betting within its borders extends all the way back to 2009, when State Sen. Raymond Lesniak introduced sports betting legislation. His bill would easily pass via voter referendum in 2011, leading then Governor Chris Christie to pass it into law the following year.
Unfortunately there was one enormous roadblock, which was the Professional and Amateur Sports Protection Amendment (PASPA) of 1992. PASPA, driven by former New York Knick Bill Bradley, prohibited sports wagering in all but four countries (and actually just Nevada). Lately, New Jersey needed a 1 year window in the beginning of PASPA to pass laws legalizing sports gambling from the country, but political turmoil doomed the effort. Because of this, New Jersey was effectively shut from sports betting for the next 25 decades.
Soon after sports gambling regulations were posted in August 2012, professional sports leagues filed a suit against Christie and New Jersey. The upcoming few years were riddled with disappointment for New Jersey, since it first lost in the district courts, then twice at the Third Circuit Court of Appeals. Then in June 2014, the state has been delivered another devastating blow, if the U.S. Supreme Court refused to accept New Jersey’s appeal.
Additionally in 2014, the constantly staunch gambling proponent Lesniak went to focus on new sports gambling legislation that would function as a type of PASPA workaround. Same effect, with New Jersey and Christie once again dropping to the leagues in the courts. However, by this time, the prevailing attitude toward sports gambling was beginning to show some cracks. Directed by this, New Jersey once more asked the U.S. Supreme Court to hear its case. This time, it accepted, hearing oral arguments in Christie v. NCAA (afterwards Murphy v. NCAA) on December 4, 2017.
Five-and-a-half month later, on May 14, 2018, the Court announced its decision, voting 7-2 which PASPA violated the 10th amendment, and deeming it entirely unconstitutional by a 6-3 count. Only a couple of weeks after, New Jersey passed a brand new sports betting bill, also at a ribbon cutting ceremony at the Monmouth Park sportsbook on June 14, 2018, the business has been born.Today, it thrives.
